OPINION OF THE COURT
GILES, District Judge.
This appeal from an award of summary judgment in favor of the defendant United States requires us to decide whether, as a matter of law, the district court properly adjudicated plaintiff's 1 tort claims arising out of a head-on motor vehicle accident. Plaintiff’s recovery is controlled by the terms of the New Jersey Automobile Reparations Reform Act (Act), N.J.Stat.Ann. § 39:6A-1 et seq. (West 1973 & Supp.1985).
