KNAPPEN, Circuit Judge.

This is an appeal from an order discharging a writ of habeas corpus involving deportation.

Appellant was born about the year 1893, in, and a citizen of, Russia. He entered the United States in the year 1.906, and has resided here ever since. He is still an alien and is unmarried. Under warrant issued by the Second Assistant Secretary of Labor, August 28, 1922, appellant was arrested on a charge of being found in the United States in violation of the Immigration Act of February 5, 1917 (Comp.
