This was a suit in equity brought up oh appeal from an adverse decree of the Circuit Court in Kansas (see 2 McCrary, 550). The plaintiff and the defendant were incorporated by the Territorial Legislature of Kansas’; and the question in controversy relates to land which they respectively claim under grants from the United States. ■ The plaintiff’s original name was the Leavenworth, Pawnee and Western Railroad Company, and it is thus termed in the act of Congress of 1862 creating the Union Pacific Railroad Company.
