This case involves á determination of the title, to about, ninety thousand acres of land situated in the State of Kansas,claimed by the two railway corporations which are parties to the suit, under grants from the United States. The plaintiff in the court below, the defendant in error here, the-Kansas Pacific Railway Company, was originally known as the Leavenworth, Pawnee, and Western Railroad Company, and is thus designated in the act of .Congress of 1862.
