This action was brought to recover the sum of $75, alleged to be due to the plaintiff from the defendant aa commissions upon the exchange of property made by the plaintiff as a broker, acting for the defendant. The summons in this action was returned as having been personally served upon the defendant herein, and was returnable on the 24th day of April, 1899. On that day the plaintiff appeared by J.
