This appeal involves the due process rights of a purchaser who holds legal title to property purchased at a judicial sale. In particular, Gary Horton (Purchaser) alleges he is an indispensable party to the property owner’s petition to set aside judicial sale. Without notice to Purchaser, the Bedford County Court of Common Pleas (trial court) granted the property owner’s petition to set aside the judicial sale to Purchaser on the ground the Bedford County Tax Claim Bureau (Bureau) failed to serve property owner with the predicate rule to show cause before judicial sale.…
