After jury trial, defendant was convicted of sexual assault in the first degree, in violation of Neb. Rev. Stat. § 28-319 (Reissue 1989), and of manufacturing child pornography, in violation of Neb. Rev. Stat. § 28-1463.03 (Reissue 1989). A posttrial hearing was held before the trial court, and the court found that defendant’s conviction for first degree sexual assault was defendant’s second conviction for that offense. After a hearing, the trial court found defendant was not a mentally disordered sex offender. The court sentenced defendant to 40 years’ imprisonment on the sexual assault…
