Defendant was indicted for the murder of Mayme Rediker, his wife. He was convicted of manslaughter in the first degree and appeals from an order denying his motion for new trial.

Defendant and the deceased were married at Faribault, Minnesota, on August 8, 1936, and thereafter lived in Minneapolis, where they both worked. Defendant had been a representative for the American Linen Company for 24 years. Mrs. Rediker had been employed as a clerk by the Dayton Company for about eight years at the time of her death.
