MR. JUSTICE ANGSTMAN:
Plaintiff has appealed from a judgment entered on a verdict in favor of the defendant after his motion for new trial was denied.
The action is to recover damages sustained by the widow and other heirs for the alleged wrongful death of George W. Hightower alleged to have been caused by the neglig*ence of defendant in driving his automobile against him. The complaint charges negligence on the part of defendant in traveling at a high and dangerous rate of speed, failing to have his automobile under proper control, and driving on the left-hand side of the highway.
