The defendant was charged with the commission of the crime of assault with intent to commit rape. The prosecuting witness was Agnes Clark, a child 12 years of age. The prosecuting witness, accompanied by her 14 year old sister, Leota, and her aunt, on the evening of July 18, 1935, went from her home some blocks away to the city park in the town of Logan, Iowa, in which town the parties live. It appears that the town was putting on what is termed a “jubilee” day, and a carnival company was setting up its concessions, among which was a ferris wheel, in the city park.
