I. The defendant company operated a street car line in the city of Ames, wherein the accident under consideration happened. In an attempt to avoid a reckless automobile, the plaintiff fell upon the street car track, in front of an on-coming car. Before he could remove himself, the car had run over his foot and crushed the same so as to necessitate amputation of the leg above the ankle.
