GOOD, J. *

Following the death of John Robbins and serious injuries to Edward Mitchell, Jr., in a single accident, two tort actions were filed against Humboldt Fir Company and three of its employees. Consolidation was ordered as well as bifurcation of trial on issues of liability and damages. At the conclusion of the liability phase, the court, sitting without a jury, found that negligence of the defendants had proximately caused the injuries; that neither Robbins nor Mitchell had assumed the risk or were contributorily negligent; that at the time of the accident, their employment had…
