This case was before us at the last April term, *80and was remanded for a new trial. 2 Robinson, 40. The pleadings and facts are fully stated in the opinion then delivered. When the cause was returned to the District Court, the defendant filed a supplemental answer, stating that since the trial in this court, he had obtained from the United States a patent for the land in controversy, whereby the absolute title to it is now vested in him; he, therefore, prays for a judgment in his favor.
