This action was commenced by appellant, Realty Executives, Inc. (Realty), a real estate brokerage firm, to collect a broker’s commission from appellee, Northrup, King & Co. (Northrup), after Northrup sold a parcel of land to Holsum Bakery. Realty alleged that Northrup wrongfully refused to pay the commission in violation of an exclusive listing agreement. Northrup asserted, as an affirmative defense, that the agreement as well as efforts to sell the land were illegal because the salesman involved was not licensed.
