The plaintiff brought an action on an oral contract. From a judgment based on the verdict of the jury, the defendant appeals.

The respondent is a builder and contractor. The appellant is a corporation engaged in the business of making mortgage loans and selling insurance. They entered into a written agreement, April 29, 1937, which provided for the sale to respondent of a number of building lots which the appellant owned in the Hawthorne Hills Addition to the city of Seattle, at stated prices.
