Lynoh, Judge:

John Cooper was convicted upon an indictment in the form prescribed by statute, charging him with the killing of Rufus Clendenin on September 4, 1912. The specific assignments of error on which he relies for reversal are the rulings of the trial court upon his demurrer to the indictment, the empaneling of the jury, the admission and rejection of evidence, the giving of instructions 1 and 4 for the state, and the refusal of his instruction number 5.
