Appeal from a judgment, of conviction and an order refusing a new trial in the Superior Court of Solano County. Gregory, J. A petition for hearing in hank was filed in this case after judgment and denied.

Thornton, J.:

The defendant was indicted for the murder of Robert Ben-ham, tried, found guilty of murder in the first degree, and sentenced to imprisonment in the State Prison for the term of his natural life. He moved for a new trial, which was, by order of the Court, denied, and he prosecutes this appeal from the judgment and order.

The principal question to be considered in this case relates to the admission of the dying declarations of the deceased. The bill of exceptions states the evidence of Craig, Reardon, and the Millsaps as to these declarations.
