Thornton, J.:

The defendant was indicted for the murder of one Glaneey, and convicted of murder in the second degree. He moved for a new trial, which was denied, and this appeal is prosecuted by him from the judgment and the order denying his motion above mentioned. On the trial many points were re*165served to the ruling of the learned Judge of the Court below, which have been elaborately argued in this Court, and which we are called on to determine.
