This action was commenced before a justice of the peace to recover on a promissory note. There was a judgment for the plaintiff, and defendant appealed to the county court. In the county court the defendant filed' an answer which consisted of a general denial and plea of the statute of limitations, and that he was only an indorser on the note, and had received no notice of its dishonor by the maker, and was therefore discharged. A jury was waived and the trial -had to the court, and judgment rendered for the plaintiff, from which the defendant has prosecuted an appeal to this…
