I. INTRODUCTION

THIS MATTER is before the Court on a hearing on Defendant AT & T’s Motion to Dismiss pursuant to Fed. R. Civ. P. 12(b)(1) and 12(b)(6), filed May 12, 2005, and Plaintiff SmartStop, Inc’s Motion for Partial Summary Judgment Regarding Statute of Limitations pursuant to Fed. R. Civ. P. 56, filed April 11, 2005. A hearing was held on the Motions on June 29, 2005. For the reasons stated on record in the hearing and in this Order, Defendant AT & T’s Motion to Dismiss pursuant to Fed. R. Crv.
