The committee found the, following facts: In the fall of 1926 the defendant, acting through its High School Building Committee, invited contractors to bid upon the construction of a new high school. The plaintiff procured from the architects a set of plans, specifications and instructions to bidders, the specifications containing a provision that the contrac tor should remove all rock encountered, except boulders, at an additional price per cubic yard provided for in the bid form.
