ALLEN, Circuit Judge.
This is a second hearing of this case, which was instituted by the filing of a petition for enforcement by the National Labor Relations Board. The Board had found the respondent guilty of violating § 8(1) and § 8(5) of the National Labor Relations Act, 29 U.S.C. §§ 151-166, 29 U.S.C. A. §§ 151-166. The unfair labor practice charged and found to exist was that the respondent had refused to bargain collectively with the United Steel Workers of America (C.I.O.), hereinafter called the Union, as representative of its plant guards.
