This is an ancillary action for attorneys’ fees, costs, and penalties for vexatious refusal to defend. The case currently pends on cross motions for summary judgment based on the meld of undisputed facts filed June 17, 1980.

Third-party plaintiff, Columbia Union National Bank [hereinafter Columbia Union] seeks recovery under the terms of a Bankers Blanket Bond issued by third-party defendant, Hartford Accident and Indemnity Company [hereinafter Hartford].
