MEMORANDUM OPINION AND ORDER

ALESIA, District Judge.

Before the court is defendants Rita Fry, Edwin Burnette1, Shelton Green, Su Horn, and County of Cook’s motion to dismiss *1482plaintiff Jake J. Duhart’s second amended complaint pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure. For the reasons that follow, the court grants in part and denies in part defendants’ motion.
