This is a workmen’s compensation case. Petitioner, as plaintiff, (parties hereafter will be referred to as they were in the trial court) appealed to the District Court of Orange County, Texas from an unsatisfactory award of the Industrial Accident Board. Plaintiff alleged that he suffered accidental injuries to his body while employed by H. W. Matthews Construction Company in Orange County, Texas.
