BRICKEN, Presiding Judge.
The judgment in this case, from which this appeal was taken, appears from the record to have been rendered in the court below on the 30th day of November, 1936. The appeal was submitted here on November 4, 1937. The case was taken up for consideration by this court on December 13, 1937, and, the writer being impressed by certain of the demurrers which were interposed to the indictment, at the time realizing the importance of the points of decision involved, we deemed it advisable and did certify certain of said .questions to the Supreme Court, under the provisions of…
