Appeal by the plaintiff, James Armstrong, from so much of a judgment of the Supreme Court, partly in favor of the plaintiff and partly in favor of the defendant Talbot, entered in the office of the clerk of the county of New York on the 4th day of March, 1904, upon the decision of the court, rendered after a trial at the New York Special Term, as adjudges that the plaintiff has failed to establish any lien or right to a lien upon the real property described in the complaint.

Patterson, J.:

This is an action to foreclose a mechanic’s lien. It was decided at the Special Term upon an agreed statement of facts,, from which it appears that the defendant Mary Chisolm was the owner of the premises against which the lien was filed. She contracted with Andrew J. Robinson, doing business under the name of Robinson & Wallace, for the performance of certain work and furnishing of certain materials and there was due from her to Robinson & Wallace the sum of $12,805, with interest.
