Error to a judgment of the Corporation Court of the city of Lynchburg in a proceeding by motion for a judgment on a life insurance policy. Judgment for the defendant. Plaintiff assigns error.

This is an action upon notice under the statute brought by the administrator of Alexander B. Stratton, Jr., deceased, against the N'ew York Life Insurance Company to *259recover of the latter the amount of an insurance policy alleged to have been held by the plaintiff’s intestate and in force at the time of his death.
