Appellants, The Houston Chronicle Publishing Co. (“Chronicle”) and Peggy O’Hare, filed suit under the Texas Public Information Act 1 and Texas Uniform Declaratory Judgment Act 2 seeking a writ of mandamus, declaratory relief, and attorney’s fees against appellee, the Honorable Tommy Thomas, Sheriff of Harris County. Both parties filed motions for summary judgment. The trial court denied as moot both motions for summary judgment.
