The defendant was convicted of unlawful cohabitation and his punishment fixed at not less than two nor more than four years in the State prison.

On October 21,1934, the defendant was married to Miss Leo McG-augh in Iuka, Mississippi. After living together for some time the parties separated in 1939, but continued to correspond with each other. The first wife of the defendant was living in Houston, Texas.
