MEMORANDUM AND ORDER

DON J. YOUNG, Senior District Judge:

This cause is before the Court on a motion by plaintiff, Secretary of Housing and Urban Development (HUD), to be placed as mortgagee in possession of property involved in a pending mortgage foreclosure proceeding. The defendant objects to the extraordinary relief sought in this motion and seeks to remain in possession during the pendency of the foreclosure proceeding.
