On January 21, 1943, tlie parties to this action entered into a contract, evidenced by the following letter: “Harrison, Arkansas, January 21, 1943, Mr. J. 0. AYillson, St. Joe, Arkansas. Dear Mr. AYilson: This letter is to provide a written understanding regarding, the sale and removal of chats now produced and in stock pile at our Excelsior mine near St. Joe, Arkansas.
