The plaintiff brought this action against the defendant for the recovery of two mirles, and alleged that he was entitled to them by virtue of two- mortgages executed by one J. C. Phillips to- him. The defendant denied the plaintiff's title and right of possession and averred that J. C. Phillips had, prior to the date of his mortgages to the plaintiff, executed two- mortgages to the Gaffney Live Stock Co. for the- same mules to secure a debt due by him to said company, which were registered before those of the plaintiff.
