This is an appeal from a judgment and decree denying probate of a will made by AVinnie Sixkiller, a full-blood Cherokee Indian. The will was signed October 28, 1926. At that time testator was about 88 years of age. She could neither read nor write, and could not speak the English language. At the time the will' was signed she had four daughters living, namely, Mary Muskrat, Elizabeth Padgett, Ora Watt, and Nannie Hogner; one son, Taylor Six-killer, had died leaving an only child, Josie Swimmer.
