Plaintiffs and appellants, husband and wife, brought this action against defendant and respondent for personal injuries claimed to have resulted from an automobile accident. The complaint was filed on April 9, 1956, alleging the accident and injuries occurred on September 4, 1954, one year, seven months and five days after the alleged accident.
