KRUEGER, Judge.

The appellant was tried and convicted of the offense of murder with malice aforethought, and his punishment was assessed at confinement in the State Penitentiary for a term of 99 years.

The record shows that on the night of the 8th day of June, A. D. 1935, Erma Lee Wilkerson, a negro girl about nineteen years of age, was killed and her body left lying at the place where the homicide was committed. When her body was found the next morning, it showed that her skull was crushed and her head beaten into a pulp. Near her body lay an iron bar about four feet long and about two inches…
