This is a suit brought to recover damages for the breach of certain alleged contracts claimed by the com plainant Lee Burns to have been made for his benefit. In short, this is an action to enforce a contract for the benefit of a third party beneficiary.

Appellant filed suit in the First Judicial District of Hinds County, Mississippi, in which he claimed to have been damaged by the alleged failure of the defendant, Washington Savings, to carry out its contract with certain persons who had entered into individual contracts to borrow money for the purpose of paying appellant, Lee Burns, money…
