Appeal from a judgment of the Supreme Court at Special Term, entered February 2, 1979 in Albany County, which denied petitioner’s application in a proceeding under CPLR article 78, to annul an order issued by the Public Service Commission. Petitioner Westchester Mobilfone System, Inc. (Westchester), is a radio common carrier providing a two-way mobil and a "beeping” service and is now licensed and regulated by respondent Public Service Commission (commission).
