The respondents move to dismiss the appeal heretofore filed with us by the petitioner from the action of the Hudson County Board of Taxation, dismissing petitioner’s appeal from the assessment on their property in Union City, New Jersey.

The evidence before us consists of a stipulation of facts, together with affidavits and exhibits.

Brieflly summarized, it appears that in the year 1945 the assessor of Union City assessed the respondents’ premises at
