Defendant Richard S. McGehee (McGehee), administrator of the estate of Susanna M. McGehee, appeals from the order of the circuit court of Cook County which granted plaintiff Safeco Insurance Company (Safeco) summary judgment on its suit for declaratory judgment. The issues before this court are whether Safeco’s complaint for declaratory judgment was premature and should have been stricken; whether Safeco’s summary judgment motion was improperly granted when a question of fact existed concerning the Brimies’ homeowner insurance policy…
