This is an action to recover damages for personal injuries brought by Frank J. Jandera, defendant in error, plaintiff below, on November 11, 1905, against the ¿Atchison, To peka & Santa Ee Bailway Company, plaintiff in error, defendant below, in the district court of Noble county.
