The exceptions taken on the trial of this action, to which our attention is called, on the argument of the appeal, are the exception to the refusal of the court to order a nonsuit, and various exceptions to the judges’ charge.
The original plaintiff, having' taken passage in an east-going train, from Buffalo to Bochester, was carried past the Boches ter station, while asleep, he having the assurance of the defendant’s conductor that he would awake him at Rochester.
