This case is presently before the Court on the defendant’s motion to dismiss.
*418The plaintiff, Hazel Miller, a married woman domiciled in Nebraska, commenced this action to recover for personal injuries allegedly suffered in an accident involving the collision of the auto in which she was riding with that driven by the defendant. The car in which plaintiff was riding was driven by her husband, Floyd P. Miller.
The defendant moves to dismiss on the ground that plaintiff’s husband is an indispensable party plaintiff.
