Tbe court submitted two special verdicts, and tbe jury returned a verdict of $750 on each. Tbe court rendered judgment for $750 on tbe special verdict founded on tbe allegation “you can keep as many as forty cows in the pasture,” and, upon motion of the defendant, set aside tbe special verdict of $750 founded on tbe allegation “there is no better land in Vermont. ’ ’ Both parties excepted.

The plaintiffs traded for tbe defendant’s farm. They relied npon certain representations made by tbe latter concerning tbe property, which turned out to be untrue, and they bring this tort action for tbe resulting damages. Tbe trial below was by jury, and at tbe close of tbe evidence the defendant moved for a verdict. This motion was overruled, and be excepted. Thereupon tbe court submitted to tbe jury as a basis of recovery these two representations set forth in the declaration: 1.
