The issue on this writ of error involves the propriety of one lien holder acquiring title to real property through a treasurer’s deed, thereby extinguishing the interests of another lien holder.

This issue became definitive in an action to quiet title to certain real property in Jefferson County, Colorado. The action was brought by the defendant in error, the First National Bank of Englewood, under R.C.P. Colo. 105. The plaintiff in error, Harold J. Miller, one of the named defendants in the trial court, had a valid judgment lien for $25,106 on the subject…
