The question on appeal is whether causing the false arrest of an adversary in a labor dispute violates the provisions of the Anti-Ku Klux Klan Act of 1871, 42 U.S.C. § 1985(3). That law makes it a federal tort for a private group to “conspire or go in disguise on the highway or on the premises of another for the purpose of depriving . any . . . class of persons of the equal protection of the laws, or of equal privileges and immunities under the laws" (emphasis added).
