OPINION

MUIR, District Judge.

Silberberg filed a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2241 alleging that the United States Parole Commission failed to apply properly its parole guidelines as set forth at 28 C.F.R. § 2.20. The case was referred to United States Magistrate Quinn to conduct necessary proceedings and to make his report and recommendation to the Court. A rule to show cause was issued on November 7, 1979 and the respondents filed an answer on November 27, 1979 which was supplemented by an affidavit filed on November 29, 1979.
