OPINION

RICHARD BARAJAS, Chief Justice.

This is an appeal from a jury conviction for the offense of evading arrest or detention. The court assessed punishment at six (6) months’ confinement in the county jail. We reverse and render.

I. SUMMARY OF THE EVIDENCE

The jury heard from Bernard Kraft, a sergeant with the Midland Police Department, who testified that on April 10, 1997 at approximately 11:00 a.m., he went to an area of the city known as “The Flats” in anticipation of setting up a mobile police *724substation.
