Atkinson, Presiding Justice.

Judge G. Y. Tigner, judge of the city court of Columbus, whose term would extend to and include December 31, 1940, died on May 1, 1938, thus creating a vacancy iñ that office. On May 6, 1938, the' Governor appointed E. C. Britton to fill the vacancy, and administered to. him the oath of *809office. Britton immediately assumed the duties of the office. On May 17 the Governor issued and forwarded to him his commission effective May 6, 1938/ to fill the unexpired term, and until his successor should be elected and qualified.
