This is the second time this matter has been before our Court. We summarize the prior proceedings and facts in part from our earlier *599opinion, Shaw v. UPS and Liberty Mutual Ins. Co., No. 91110IC855 (N.C. App. filed 20 October 1992):
On 7 December 1987, plaintiff sustained a compensable injury by accident arising out of and in the course of his employment with defendant-employer.
